why history predicts romney's polls right now give him only a narrow path of winning this election. plus, scoops and prediction chris: welcome back. history shows the power of presidential debates that catapulted kennedy from behind to ahead and onto victory. but to do that means getting a clean debate win. enough to change the polls. here's a tough pattern for mitt romney. when the polls have changed from september to october, the incumbent, not the challenger, usually is the one improving. the incumbent has seen polls go up an average of 4.6% while challengers have even only an average of 2.5% gains in october. and finally there's very low volatility or changing of minds in recent presidential races. there are only a few truly undecided voters out there. and voters tend to lock in early. specialy -- especially in recent years. if you look at elections since 1996, the polls have not moved much from mid september to election day. the average change has been about 3.7%. even when they get off the fence. a couple of problems for romney. one, the tendency of voters to be hesitant about

the winner regardless. >> there's a big problem, lots of big problems for mitt romney right now, but this 47% thing. if you're barack obama, as he has been doing these attack ads the last few days, he will hammer mitt romney over the head throughout this debate about 47%. if he doesn't, he's mad. because it's an incredibly powerful hammer to use, because whichever way you try and spin that, it was a disaster. he called half of the country a bunch of scrounging victims. what does mitt romney do if barack obama does that? >> mitt romney has said a couple things since, piers. the first thing he said was that was me, not my campaign. he actually took responsibility which i appreciate when a grown man says i'm sorry, i made a mistake. number two, number two, his campaign is all about 100% of america and here's what he meant. he said it was inelegantly stated but i agree, not just the president will take him to task on that but i think the debate questioners will ask him. but romney should look at that as an opportunity not to be defensive again but to explain precisely what he meant. the

[laughter] that is not the case. i will not reduce the taxes paid by high-income americans. and number three, i will not under any circumstances raise taxes on middle income families. i will lower taxes on middle income families. now, you cite a study. there's six other studies that lo

all right, the next presidential debate it ten days away. will governor romney keep his momentum going or will president obama do better this time at a lower altitude? indiana congressman dan burton and texas congress woman sheila jackson-lee join us. how are you this evening? >> fine, thank you. >> what do we think about that claim? think it could have been the altitude? i will start with you congress woman jackson-lee. >> that claim never came from president obama nor his camp nor any of us who think atoutly astutely, debates don't govern or provide healthcare or o investment in innovation and provide opportunities for young people for higher education and doesn't provide a safe and secure nation. that is what president obama can stand on over the last couple of years and certainly stand on improved rates that show our jobless numbers are going down. >> judge jeanine: we appreciate you saying that. why couldn't the president say that himself? why couldn't the president say what she just said? >> i can't comment about what the president did

certainly mitt romney is far to the right on things like women's issues, on choice, on judge, on all those things, but i think the conversation has been more about is he for the top over the folks who are in the middle and at the bottom. if you look at what he did at the debate, he tried to, you know, wiggle his way out of being this guy who is just for the top, this plutocrat that american people think he is basically and that he is, and the truth of the matter is that his position, the things that he has espoused on the campaign trail that he used to get through the republican primary, are positions that are very focused on the top and it looks like what the campaign is doing and what the press is doing is pointing out mitt romney is not telling the truth about the positions he has. >> yeah. but that's presuming he's going to stay on one message or the other. the most shocking thing about the debate, you're not going to do the 20% across the board tax cut, now you like certain parts of the obama care, but it muddles the president's tactics in terms on hammering him on things if tho
